US-Canada-Mexico Trade Pact Finalized by the Administration, Replacing NAFTA Mostly in Name Only

The administration finalized a new trade pact with Canada and Mexico which closely mirrors the old trade pact, with a few exceptions and with a new name.

The new version of the NAFTA agreement leaves the TN visa program unchanged – it continues to exist with the same list of acceptable positions and same rules. Most of the changes seem to involve dairy products, how manufacturing content is determined for purposes automobile tariff exemptions, and adds some intellectual property protections.

In an attempt to claim that the new trade deal is significantly different than the existing NAFTA regime, the administration has rebranded it the “United States-Mexico-Canada-Agreement” (“U.S.M.C.A”), although very little has changed from the existing NAFTA regime beyond the changes noted above.
